Illegal Disposal
Enforcement.
The exposure no policy will ever answer, included here precisely because owners assume insurance is relevant to it.

Which policy actually responds
And, just as importantly, which one does not.
Nothing, for the conduct itself
Deliberate acts are excluded from general liability and from pollution liability alike. Criminal fines are uninsurable as a matter of public policy.
Pollution liability, for an accidental release
Which is the distinction that matters. A hose failure or a valve that fails is a different thing from a decision to open one.
Employee dishonesty or crime cover, sometimes
Where an employee acts against the business’s own instructions and the business suffers a loss. This is narrow and form-specific.
Your licence, which is the real loss
Debarment from municipal contracts and loss of a disposal permit end the business faster than any fine.
What stops it happening to you
Know where every load actually went
Disposal receipts and manifests are the evidence file. Reconstructed records are themselves a chargeable offence in documented cases.
Never commingle waste streams casually
Mixing commercial grease into domestic septage reclassifies the entire load and changes where it can lawfully go. See our grease trap page.
Vet and monitor drivers
The documented pattern runs through driver decisions. A documented route and disposal trail protects the business from its own staff.
Make the lawful route the easy route
If the nearest receiving station is far and expensive, somebody eventually does the arithmetic. That is a business design problem, not a compliance poster problem.
Illegal Septage Disposal and Clean Water Act Enforcement
What actually happened
A Longview, Washington septic pumping company and its owner were convicted at a bench trial in December 2013. The business pumped septic, grease trap and industrial wastewater, minimally treated it, and routinely dumped the commingled waste down an unauthorised sewer port at its own yard, over two million gallons across four and a half years, pre-dawn to avoid detection. After a city records review the company filed false documents underreporting volumes. EPA investigators seized the company’s own surveillance video showing 24 illegal dumping events in six weeks. The owner was convicted on 25 Clean Water Act counts, six counts of mail fraud and two of false statements, and was sentenced to 27 months in prison with a $250,000 fine shared by the company.

That depends on your endorsements rather than your limits. Two policies with identical limits can behave completely differently on this scenario. Send your declarations including the endorsement schedule and we will tell you what we find.
