Workers are overcome by sewage gas inside a tank, manhole or lift station. A septic tank meets every criterion for a permit-required confined space, and hydrogen sulfide becomes undetectable by smell at roughly the concentration it becomes lethal. These claims are severe, frequently multi-fatality, and the citations usually record that no entry programme existed at all.
What You Get

Which policy actually responds

And, just as importantly, which one does not.

02

Employers liability

Where families sue the employer directly. Severity here is effectively uncapped by the comp schedule.

03

Umbrella or excess

Sits above employers liability where it is scheduled as underlying. It does not sit above statutory comp benefits.

04

Nothing, for the penalties

Sixteen serious violations is a business cost. No policy responds to it.

Why It Matters

What stops it happening to you

02

Monitor, because your nose will not

Odour threshold is a fraction of a part per million; loss of smell happens at the level NIOSH calls immediately dangerous to life. A crew reporting that “the smell went away” is describing an emergency.

03

Plan the rescue before the entry

The repeated pattern in published fatality records is the would-be rescuer dying second. An untrained rescue attempt is how one casualty becomes several.

04

Write the programme down

In the case above, the absence of a written programme, training and an emergency plan accounted for most of the sixteen violations.

The Incident

Confined Space Fatality in a Sewer or Septic Tank

What actually happened

In August 2025 three workers installing and repairing sewer lines inside a manhole in Mobile, Alabama were overcome by sewage gas. One regained consciousness and self-rescued. Two died. OSHA found the employer had no confined space entry programme, no entry procedures, no training, no emergency response plan, and had made no determination of acceptable entry conditions. Sixteen serious violations, $257,707 in penalties.

Questions We Get A Lot

Straight answers, no insurance-speak

Death benefits to dependents and medical costs for survivors. On a multi-fatality incident this is the largest single exposure most septic businesses will ever face.

Sixteen serious violations is a business cost. No policy responds to it.

It can hold a hazardous atmosphere, liquid septage is an engulfment hazard, and a baffled tank with one riser can trap an entrant. That is three of the four permit triggers before anyone opens a lid.

In the case above, the absence of a written programme, training and an emergency plan accounted for most of the sixteen violations.

That depends on your endorsements rather than your limits. Two policies with identical limits can behave completely differently on this scenario. Send your declarations including the endorsement schedule and we will tell you what we find.
